Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the TetherTickets websites, apps, and services (the “Service”) as a visitor or ticket buyer. By using the Service or buying a ticket, you agree to these Terms and to our Privacy Policy. If you are a business listing events, the separate Merchant Terms of Service also apply to you.

1. Who we are

TetherTickets is a technology platform that lets event organizers (“Merchants”) list events — primarily tethered hot-air balloon rides and related festivals — and sell tickets to the public. We are not the operator of the events or the balloon rides. The Merchant and its balloon pilots are solely responsible for operating the event safely and lawfully and for honoring the tickets they sell.

2. Eligibility and your account

  • You must be at least 18 years old to buy tickets or create an account. Minors may participate in an event only with the consent and supervision of a responsible adult who signs any required waiver on their behalf.
  • An account is created automatically when you buy a ticket. You are responsible for keeping your sign-in email and any 2FA device secure, and for all activity under your account.
  • The information you give us (name, email, phone) must be accurate and current so we can deliver your tickets and event notifications.

3. Tickets and your purchase

  • A ticket is a limited, revocable license to attend the specific event for which it was issued, subject to the Merchant's rules and these Terms.
  • Each ticket carries a unique QR code. Do not share, copy, or sell your ticket except through the sharing tools we provide. A ticket may be redeemed only once; the first valid scan wins.
  • Prices, taxes, and any service or processing fees are shown before you pay. Some events may be free; others may pass platform or card fees through to you, which is disclosed at checkout.
  • We may cap quantities, refuse or cancel a purchase we reasonably believe is fraudulent, and correct obvious pricing errors.

4. Queue, wait times, and ride times

Many events use a virtual queue. Any position, wait time, or predicted ride time we show you is an estimate only — it depends on weather, wind, equipment, pilot availability, and crowd size, all of which can change without notice. Estimates are not guarantees. For presale events you may need to check in on arrival (by tapping “I'm here” or scanning a posted code) to join the line, and if you are called and do not appear within the posted window, your place may be passed while your ticket remains valid for the rest of the day.

5. Safety, waivers, and assumption of risk

Tethered balloon rides and similar activities involve inherent risks, including risks of serious injury. Participation is voluntary and may require you (and any minor in your care) to sign a liability waiver and assumption-of-risk agreement provided by the Merchant before boarding. You agree to follow all safety instructions and eligibility rules (such as age, height, weight, health, or weather restrictions). The Merchant and pilot may refuse or stop a ride at any time for safety reasons. TetherTickets does not control and is not responsible for the safety or conduct of any event or ride.

6. Payments

Card payments are processed by our third-party payment processor (Stripe). We do not store your full card number. By paying you authorize the charge shown at checkout. Some Merchants may also accept other methods (for example cash or peer-to-peer apps) at on-site kiosks; those are handled by the Merchant. You agree to the payment processor's terms as applicable.

7. Refunds and cancellations

Refunds and event cancellations are governed by our Refund & Cancellation Policy. In general the Merchant sets the refund policy for its event; if an event is cancelled you may be offered a refund, account credit, or a rescheduled ride. Please read that policy before purchasing.

8. Communications

We send transactional email and, if you opt in, text messages related to your tickets and events. SMS is governed by our SMS Communications Terms — reply STOP to opt out or HELP for help. You can manage preferences on your account page.

9. Acceptable use

You agree not to:

  • resell, counterfeit, or fraudulently obtain tickets;
  • probe, scan, disrupt, or attempt to gain unauthorized access to the Service;
  • scrape, reverse-engineer, or copy the Service except as allowed by law;
  • use the Service to break the law or infringe anyone's rights; or
  • harass event staff, pilots, or other attendees.

10. Intellectual property

The Service, including its software, design, and TetherTickets trademarks, is owned by TetherTickets and its licensors. Event listings and images are owned by the Merchants that submit them. We grant you a personal, non-transferable, revocable license to use the Service to browse events and manage tickets you buy.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT EVENTS WILL OCCUR AS DESCRIBED, THAT RIDES WILL BE AVAILABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TETHERTICKETS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM AN EVENT OR RIDE OPERATED BY A MERCHANT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TETHERTICKETS FOR THE TICKET GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless TetherTickets from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

14. Disputes and governing law

These Terms are governed by the laws of the jurisdiction in which TetherTickets is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located in that jurisdiction, and you consent to their jurisdiction. Disputes about an event, ride, or refund are primarily between you and the Merchant.

15. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated version here with a new effective date. Your continued use of the Service after that means you accept the changes.
